Can I terminate my lease early?
You can cancel the lease prematurely, at the earliest by the first day of the second year of the lease term. You must observe a notice period of at least 1 month. To cancel, send a letter or email to the lease company. In case of early termination you pay a termination fee. This severance payment is separate from the settlement of any damages and other amounts. The cancellation fee must be paid before the day on which the cancellation is made. If this is not done, the cancellation will have no effect and the lease will continue until it otherwise comes to an end. If you want to cancel the lease in the first year, you pay the monthly installments up to and including the first year in full. After that, the cancellation fee applies.
What are the costs for an early termination?
In case of cancellation at the start of the second year of the lease term or at a later date, the following applies to the cancellation fee:
- For each month that the lease is terminated before the end date of the lease term, you pay a fixed termination fee of 50% of the total remaining monthly installments.
- If the calculation shows that a recalculation of the lease term to a shorter term offers you an overall more favorable outcome than the fixed termination fee of 50%, then recalculation is chosen.
- If you conclude a new private lease agreement with the lease company with at least the same term as the original term of the lease that can be terminated early, a termination fee applies.
Calculation of fixed termination fee percentage:
Suppose you have a Private Lease Agreement with a term of 36 months, a monthly term of € 89 and you want to terminate the lease after 24 months. The fixed termination fee is then 50% x 12 months remaining term x € 89 = € 534.
Calculation via recalculation
The recalculation shows that for a term of 24 months a monthly installment of € 104 applies. Settlement based on the recalculation means for you an amount of 24 months x (€ 104 - € 89) = € 360.
Final Termination Fee
Since the calculation of the cancellation fee via the recalculation is cheaper for you, this is chosen. You must pay the determined termination fee by transfer to the bank account of the lease company before the termination date. The amount is not automatically collected. If the termination fee is not received by the leasing company before the termination date, the lease agreement will continue until such time as the termination fee has been received.
